Terms of Use

These Terms of Use (“Terms”) govern your access to and use of AfterCrash.claims (the “Service”), operated by Brilliant Empire LLC (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

AfterCrash.claims provides an informational claim-health quiz, a directory of approved providers (including attorneys, medical/care providers, and transportation providers), and tools that let visitors optionally request contact from a selected provider. Provider and admin accounts support directory applications, profile management, lead handling, and moderation.

2. Important disclaimers

• Not a law firm. Brilliant Empire LLC is not a law firm and does not provide legal advice.
• No attorney-client relationship. Using the Service, completing the quiz, viewing listings, or submitting a connect request does not create an attorney-client, doctor-patient, or other professional relationship with us or any provider.
• Informational only. Quiz results, scores, and directory information are for general informational purposes only. They are not a diagnosis, case evaluation, guarantee of outcome, or substitute for advice from a qualified professional.
• Independent providers. Providers listed on the Service are independent third parties. We do not control their advice, services, availability, fees, or conduct, and we do not endorse any particular outcome.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Accounts

Provider and admin users are responsible for maintaining the confidentiality of their login credentials and for activity under their accounts. You must provide accurate information and promptly update it. We may suspend or terminate accounts that violate these Terms, appear inactive, or present risk to the Service or other users.

5. Visitor use and lead requests

You may use the quiz and browse directory results subject to these Terms. If you submit a connect request, you:

• Confirm the information you provide is accurate
• Authorize us to share your request details with the selected provider and our administrators
• Consent to be contacted by that provider about your request
• Understand that submitting a request does not guarantee that a provider will accept your matter or respond within any particular timeframe

6. Provider terms

If you apply to or appear in the directory as a provider, you agree that:

• You will submit truthful, current, and complete profile information, including licensing information where applicable
• Listing is subject to our review and approval; we may approve, reject, suspend, or remove listings at our discretion
• Sensitive edits (such as category or license details) may require re-review before publishing
• You will handle lead information lawfully, securely, and only for legitimate follow-up related to the visitor’s request
• You are solely responsible for your professional services, compliance with applicable laws and ethics rules, and communications with visitors
• You will not use the Service to spam, mislead, scrape, or interfere with other users or systems

7. Acceptable use

You agree not to:

• Violate any law or third-party right
• Attempt unauthorized access to accounts, data, or systems
• Interfere with or disrupt the Service
• Upload malware or harmful code
• Scrape, harvest, or systematically collect data except as expressly allowed
• Misrepresent your identity, credentials, or affiliation
• Use the Service for unlawful advertising or solicitation

8. Intellectual property

The Service, including its design, text, branding, software, and content we provide, is owned by Brilliant Empire LLC or its licensors. You receive a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You may not copy, modify, reverse engineer, or create derivative works from the Service except as allowed by law.

Providers retain ownership of content they submit, and grant us a non-exclusive license to host, display, and use that content to operate and promote the Service and directory.

9. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms.

10. Third-party services

The Service may rely on third-party hosting, authentication, email, and other tools. We are not responsible for third-party services we do not control. Links to provider websites or external resources are provided for convenience only.

11. No warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT QUIZ RESULTS OR DIRECTORY INFORMATION WILL BE ACCURATE OR COMPLETE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRILLIANT EMPIRE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to defend, indemnify, and hold harmless Brilliant Empire LLC and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, your professional services, or your violation of these Terms or applicable law.

14. Suspension and termination

We may suspend or terminate access to the Service, remove listings, or refuse lead delivery at any time if we believe it is necessary to protect the Service, users, or our legal obligations, or if you breach these Terms. Provisions that by their nature should survive termination will survive.

15. Changes

We may update these Terms from time to time. We will post the updated Terms on this page and revise the effective date. Continued use after changes become effective constitutes acceptance of the updated Terms.

16. Governing law

These Terms are governed by the laws of the United States and the State in which Brilliant Empire LLC maintains its principal place of business, without regard to conflict-of-law rules. Courts located in that State will have exclusive jurisdiction over disputes arising out of these Terms, except where prohibited by law.
